Senior Tax Advisor/Supervisor

 Extensive (direct- and indirect) Tax Experience in Africa and South Africa. I currently manage the tax affairs of our interests in 9 African countries and our South African Operations.

 Tax Regime Research and Tax Legislation interpretation: I conduct the tax research on all new oil and/or gas ventures being considered in the African region for the Group, advise the business accordingly and recommend a tax efficient approach.

 Identifying and Communicating Tax Costs, DTA Relief and Tax Concessions relevant for economic analyses: This entails, inter alia, a full understanding of the following:

o Corporate tax, royalties, signature- and production bonuses, cost recovery, state participation, employees tax, customs taxes, withholding taxes, Value Added Tax (including Reverse Value Added Tax), dividend tax, transfer pricing restrictions, local social security, etc.;
o Double Taxation Agreements, to ensure any tax relief available is fully understood and properly communicated to the other business functions (including recommendations on how to optimise utilisation thereof in a proper manner);
o “Tax pitfalls” (tax rules which would result in abnormally high tax costs, given the norm in the Industry) for negotiation/lobbying purposes;
o Tax cost risks quantification – a proper understanding of potential exposures and –additional costs.

 Tax lobbying: Collaborate with Legal Department by pointing out areas where tax lobbying/negotiation would be appropriate (e.g. in Model Product Sharing Agreements, Draft Finance Law Amendments)

 Management of Cape Town Tax Portfolio (currently 9 African jurisdictions and SA): Providing advice on tax rules applicable to portfolio managed from Cape Town, including, for example, transfer pricing considerations, dividend tax implications, tax deductibility (and cost recovery-) restrictions, withholding tax- and reverse VAT exposures, royalties and profit oil sharing, tax concessions available as a result of Product Sharing Contracts or local petroleum laws, double taxation relief, etc.
